These Terms of Service (“Terms”) govern your access to and use of the BiasharaPOS application, website and related services (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.
Eligibility & accounts
You must be a registered business or an authorised representative to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.
Pricing & payment
BiasharaPOS is free of charge for businesses processing up to 1,000 sales per month, with all features included. Above this limit, the Service is offered on a flat monthly subscription of TZS 200,000 with no per-transaction charges. Where fees apply, they are billed in advance and are non-refundable except where required by law. We will give you notice before any change to pricing takes effect. BiasharaPOS does not process your customers’ payments: money from a sale moves through your own account or terminal, and we record only the method and any reference you enter.
Acceptable use
You agree not to misuse the Service, including by attempting to access it through unauthorised means, reselling it without permission, or using it for unlawful activity. You are responsible for the accuracy of the sales and tax data you record.
Your online shop and deliveries
If you open an online shop, you are the seller. You are responsible for what you list and the prices you set, for having the stock you offer, for fulfilling or cancelling orders, and for anything your own riders do while delivering for you. We pass orders and messages between you and your customers; we are not a party to the sale.
Your customers’ details belong to them and to you, not to us — we hold them on your behalf. You are responsible for handling them lawfully, including under Tanzania’s Personal Data Protection Act, and for answering your customers if they ask what you hold about them. Order messages are sent in your shop’s name, so keep them to what the order requires; the Service is not for marketing campaigns.
Tax compliance
The Service helps you issue fiscal receipts built to the TRA VFD specification, but you remain responsible for meeting your own tax obligations under Tanzanian law. We are not a substitute for professional tax or accounting advice.
Availability & liability
We work to keep the Service reliable. Counter sales continue when your connection drops and sync when it returns; table service, the kitchen screen and online orders need a working connection. We provide the Service “as is” without warranties of uninterrupted availability. To the maximum extent permitted by law, BiasharaPOS is not liable for indirect or consequential losses arising from your use of the Service.
Termination
You may cancel your subscription or stop using the Service at any time. We may suspend or terminate access if these Terms are breached. On termination you can export your data subject to applicable legal retention periods.
Changes & governing law
We may update these Terms from time to time and will post the revised version here. These Terms are governed by the laws of the United Republic of Tanzania.
